    In this slip and fall case, our client was visiting a family member at a nearby hospital. On her way out of the hospital, she slipped on a wet area in a hallway. The evidence showed that there were no signs or cones that warned our client that the floor was wet or slippery. Moreover, testimony revealed that a nurse immediately came to assist our client and commented that the area was wet and there were not any warning signs.

    As a result of the fall, our client suffered a fracture to her left elbow that required surgery. The required surgery resulted in an approximately four-inch scar to the left elbow area and physical therapy for approximately four weeks. Our client also was evaluated and given a 13% impairment rating to her upper extremity (left elbow).

    Stanley Personal Injury Lawyers, along with co-counsel Kelaher, Connell, and Connor, received a jury verdict for their client in the amount of $6,750,000 against a developer/general contractor.

    This case involved a nine building, 111 unit condominium project known as the Wedgewood Condominium Association (“HOA”) in the Barefoot Resort area of North Myrtle Beach, South Carolina. Through investigations by a forensic architect, the HOA identified numerous violations of building code, industry standards, and manufacturer specifications by the developer/general contractor from original construction.

    As a result of the construction violations, the HOA brought suit against the developer/general contractor for several causes of action including negligence, breach of implied warranties, breach of fiduciary duty, and unfair trade practices. Approximately thirty parties were involved in the case and the matter was heavily litigated over a five-year period with extensive discovery processes and depositions of witnesses and expert witnesses.

    Although the case had been mediated on at least two separate occasions, the parties failed to settle the case prior to the trial date. Trial began on May 22, 2023 and lasted for five days. In its case in chief, the HOA put up a former HOA President, a forensic architect, and an estimator. After deliberating for about four hours, the jury returned a verdict for the HOA for $6,750,000.
