The Stanley Law Firm has been serving the residents and visitors of Atlantic Beach for almost 20 years. Atlantic Beach is small in population – only several hundred people – and geographic size – less than half a square mile in between Myrtle Beach and North Myrtle Beach. However it hosts one of the biggest motorcycle festivals in South Carolina – Atlantic Beach Bike Week.
The Stanley Law Firm is very experienced with South Carolina motorcycle laws and statutes. Here are a few motorcycle laws from the South Carolina Code of Laws you should be aware of.
Helmets – If you are under 21 you are required to wear an approved helmet and some form of eye protection. Helmets are not required for those 21 and over.
License – You need a Class M driver’s license to drive a two-wheel motorcycle or a two-wheel motorcycle with a detachable side car. If you have a detachable side car you need to pass a side car road test. Upon passing the test an S3 restriction will be added to your motorcycle license. You can drive a three-wheel motorcycle, also called a trike, with any license except a moped license.
Title and Registration – In order to drive a motorcycle in South Carolina, you must have a Title for your motorcycle and register it.
Riding and Driving Restrictions – A person operating a motorcycle cannot carry a package or other item which would prevent them from keeping both hands on the handlebars. A passenger cannot ride on a motorcycle unless the motorcycle is designed for two people or on an additional seat attached to the motorcycle at the rear or side.
Motorcycles are entitled to full use of a lane and no motor vehicle shall be driven in such a manner as to deprive any motorcycle of the full use of a lane. While driving a motorcycle you cannot overtake and pass in the same lane occupied by the vehicle being overtaken.
It is illegal to drive a motorcycle between lanes of traffic or between adjacent lines or rows of vehicles. Motorcycles cannot be operated more than two abreast in a single lane.
Footrests and rearview mirror – Any motorcycle carrying a passenger, unless in a sidecar or cab, must have footrests for the passenger. A rear view mirror is necessary to operate a motorcycle in South Carolina.
